Terms and conditions
These terms apply to all contracts between Alessandro Napolitano ("Storyvelle", "we") and our customers about the Storyvelle service. Part B contains additional terms for institutions.
Part A – All customers
1. The service
Storyvelle helps families to record the life stories of a person (the "storyteller"). For the agreed period (usually 52 questions) we send the storyteller one question per week – by phone interview (Life Book Plus), voice message link, email, on the web or on printed question cards. Answers are transcribed, gently edited without inventing content, and can be read, listened to and commented on by invited family members. At the end, or earlier if you wish, the stories become a printed book.
2. Conclusion of contract
The presentation of our products on the website is not a binding offer. By clicking the order button you submit a binding offer; the contract is concluded when we confirm the payment by email. The contract language is the language of the website you ordered in.
3. Storyteller consent
Recordings start only when the storyteller has agreed. The storyteller can pause or stop at any time. If the storyteller does not agree, you may switch to written answers or withdraw from the contract within the withdrawal period; after that, we refund the unused part of the price if no story has been recorded.
4. Content and rights
The stories belong to the storyteller and the family. You grant us the rights we need to store, process, lay out and print the content for you, and nothing more. We do not use content for advertising or to train AI. You make sure that uploaded photos and texts do not infringe the rights of others.
5. Prices and payment
All prices are one-off prices unless stated otherwise. For customers in the EU, the UK, Switzerland, Norway and Australia, prices include VAT; for customers in the USA and Canada, sales tax is added at checkout. Payment is due when ordering.
6. Vouchers
Vouchers are valid for three years from purchase and can be redeemed once. The start date can be chosen freely when redeeming.
7. Printed books
The included book is printed in hardcover and shipped free of charge to one address. Additional copies can be ordered by every family member. Delivery times depend on the destination country and are shown before ordering. Before printing you can check every page in the preview; obvious technical defects of a printed book are corrected by reprinting at our expense.
8. Finishing early and extension
You can finish the project at any time and order the book with the stories collected so far. There is no refund for unused weeks. A project can be extended by a further 52 questions at the price shown.
9. Fair use
To keep the service affordable, phone interviews are subject to the limits stated on the pricing page. If a limit is reached, only calls pause until the next month; all other ways of answering keep working.
10. Availability and archive
We aim for continuous availability but cannot guarantee it. Recordings behind the QR codes remain available for as long as the account exists. Independently of this, you can download all recordings in open formats at any time.
11. Liability
We are liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence we are only liable for the breach of essential contractual obligations, limited to the typical, foreseeable damage. Liability under product liability law remains unaffected.
12. Right of withdrawal
Consumers have a statutory right of withdrawal; details are given in the information on the right of withdrawal.
Part B – Institutions
13. Scope
Part B applies to care homes, residences, hospices and other institutions ("institutions") that use Storyvelle for their residents. Institutions act as businesses; the right of withdrawal does not apply.
14. Prices and billing
Institutions pay a monthly price per active resident according to the volume tiers on the pricing page; the first 30 days are free. A resident is active in a month if their life book existed during that month and was not finished before it began. We invoice monthly in arrears; invoices are payable within 14 days. The contract can be terminated at the end of each month.
15. Data processing
The institution is the controller for its residents' data; Storyvelle processes this data on behalf of the institution. The data processing agreement pursuant to Art. 28 GDPR in its current version is part of these terms. The institution is responsible for obtaining and documenting the consent of the residents or their legal representatives before the first recording.
16. Staff accounts
The institution keeps staff access up to date and removes access for people who leave. Relatives invited by the institution become users with their own rights.
Part C – Final provisions
17. Changes to these terms
We may change these terms with effect for the future if there is a valid reason (e.g. changes in law). We will inform you by email at least six weeks in advance; if you do not object, the changes are deemed accepted. We will point this out separately in the notification.
18. Applicable law
The law of the country in which we have our registered office applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country of your habitual residence.
